Aiyedatiwa Loses Appeal in Eligibility Case, Ordered to Pay ₦3m Costs

The Court of Appeal in Abuja has dismissed an appeal by Ondo State Governor, Lucky Aiyedatiwa, challenging a ruling that questioned his eligibility to contest the next governorship election in the state.

In a unanimous decision on Monday, a three-member panel held that the Federal High Court in Akure properly exercised its discretion when it allowed the plaintiff, Akindele Egbuwalo, to amend his originating summons in the case.

Delivering the lead judgement, Justice Uchechukwu Onyemenam said the governor failed to prove that the trial judge’s decision caused him injustice or denied him a fair hearing. The court therefore dismissed the appeal for lacking merit and ordered Aiyedatiwa to pay two million naira in costs.

The appellate court also rejected a separate application by the governor seeking to set aside its order of January 27, 2026, which stayed further proceedings in the case. The court ruled that the order was valid and advised that any further challenge should be taken to the Supreme Court, while awarding an additional one million naira in costs against him.
