Justice Osatohanmwen Obaseki-Osaghae of the National Industrial Court of Nigeria has ordered the Federal Government and the Registrar of Trade Unions to register the National Association of Non-Teaching Staff of Nigerian Universities, known as NANTS, as a trade union.
Delivering judgment, the court ruled that the refusal of the Registrar of Trade Unions and the Minister of Labour and Employment to register NANTS was wrongful. The court directed the immediate issuance of a certificate of registration under the Trade Unions Act.
The suit was filed by Comrade Niyi Akinnibi against the Registrar of Trade Unions, the Minister of Labour and Employment and the Attorney General of the Federation, seeking legal recognition for the new union.
Justice Obaseki-Osaghae also granted a perpetual injunction restraining the defendants and their agents from denying NANTS registration. The union was formed by members who broke away from the Non-Academic Staff Union of Universities, NASU, and has branches in federal and state universities across Nigeria.
