Court Dismisses Challenge to Rivers State Emergency Rule

A Federal High Court in Abuja has dismissed a suit contesting the legality of President Bola Tinubu’s declaration of emergency rule in Rivers State. The ruling concerned the six-month suspension of Governor Siminalayi Fubara, the state assembly, and the appointment of retired naval chief Ibok-Ete Ibas as sole administrator in March.

Five plaintiffs, led by Belema Briggs, had filed the case against the president, Ibas, and the federal government. However, Justice James Omotosho ruled that the court lacked jurisdiction to determine the legality of such proclamations.

According to the judgment, only the Supreme Court has authority to decide on the validity of a presidential declaration of emergency. The judge stressed that no other court can rule on the matter, as it directly concerns constitutional powers vested in the president. Emergency rule in Rivers was lifted in September.
