The Federal High Court in Lagos has struck out a suit challenging the Lagos-Calabar Coastal Road project, filed by indigenes and property owners of Okun-Ajah Community in Eti-Osa Local Government Area. Justice Akintayo Aluko ruled that the court lacked jurisdiction and transferred the case to the Lagos State High Court for proper adjudication.
The plaintiffs, led by Chief Saheed Olukosi and four others, sought to stop the project, alleging encroachment on their land. They requested the court to set aside the construction plans and restrain the Federal Ministry of Works, the Lagos State Government, and Hitech Construction Limited from further work on the disputed land.

However, the defendants, including the Minister of Works, Dr. Dave Umahi, and other federal and state agencies, filed preliminary objections, arguing that the case should be dismissed for lack of jurisdiction. Justice Aluko ruled in favour of the objectors, stating that the case should be heard at the appropriate state court.
The decision means the legal battle over the Lagos-Calabar Coastal Road project will now continue at the Lagos State High Court, where the plaintiffs will have to reargue their claims.
