The Lagos State Government has petitioned the Supreme Court to overturn a Court of Appeal ruling that quashed the conviction of Femi Olaleye, Managing Director of Optimal Cancer Care Foundation, on charges of child defilement and sexual assault by penetration.
Filed by the Director of Public Prosecutions, Babajide Martins, the appeal challenges the appellate court’s decision on three grounds. These include its insistence on corroborative evidence from the alleged survivor and the prosecution’s omission of testimony from the Divisional Police Officer, DPO.

The state government argues that the judgment undermines justice and seeks a Supreme Court order to reinstate Olaleye’s conviction and sentence, as determined by the trial court.
This legal escalation follows the Court of Appeal’s controversial ruling on 29 November 2024, which had annulled Olaleye’s earlier conviction, sparking public debate over the handling of such sensitive cases.
