The Supreme Court has fixed 26 May, 2023 to deliver judgment in a suit seeking the disqualification of President-Elect Bola Tinubu and Vice-President-Elect Kashim Shettima as the flag-bearers of the All Progressives Congress.
The suit filed by the Peoples Democratic Party (PDP) claims that Senator Shettima’s nomination as the President-Elect’s running mate was in breach of provisions of certain sections of the Electoral Act 2022.
The PDP argues that his nomination to contest the position of Vice-President and Borno Central Senatorial District seats at the same time contravened the law.

The PDP is also seeking an order nullifying the candidacies of both the President-elect and Vice-President-elect.
The suit was initially filed at the Federal High Court in Abuja where Justice Inyang Ekwo dismissed it on the grounds that the PDP lacked the locus standi to institute the suit.
The party appealed the judgment, but a three-member panel of the Court of Appeal upheld the judgment of the high court.
