The Supreme Court has upheld the leadership of the Hon Martin Amaewhule-led Rivers State House of Assembly, ruling that there is no evidence to support claims that 27 lawmakers defected from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC). In a 62-page judgment signed by Justice Emmanuel Agim, the court noted that Governor Siminalayi Fubara, who initially made the allegations, later withdrew them at the Federal High Court in Abuja.
The apex court ruled that in the absence of proven defection, the status quo in the House of Assembly remains unchanged. It further held that under the 1999 Constitution, there cannot be an Assembly outside the one recognised by law, dismissing Governor Fubara’s stance that only four lawmakers constituted the authentic legislative body.

Justice Agim stated that any requests, nominations, or presentations made by Governor Fubara to the House of Assembly must go through the Amaewhule-led leadership, which is believed to be loyal to former governor Nyesom Wike.
