In the petition brought by the Peoples Democratic Party (PDP) and its presidential candidate, Atiku Abubakar, the court dismissed the grounds of Mr Abubakar, alleging dual citizenship and a drug conviction of President Bola Tinubu.
Justice Moses Ugo held that the grounds were new issues bordering on the President’s non-qualification to contest the February 25 presidential election.

He upheld the objections of the All Progressives Congress and President Tinubu that Mr Abubakar and the PDP cannot smuggle new issues not pleaded in their petition on the grounds of non-qualification.
