Appeal Court Upholds Nullification of Ebonyi LG Polls

The Court of Appeal in Enugu has affirmed the nullification of the 2022 local government elections in Ebonyi State, dismissing three appeals challenging the earlier ruling.

Justice Joseph Ekanem, delivering the lead judgment, upheld the validity of the Federal High Court’s decision which voided the polls, declaring that the appellants—including the Ebonyi State Government, the Central Bank of Nigeria, and the elected chairmen—failed to present a competent case.

The court ruled that the disputed elections of 30 July 2022 were not legally conducted, and the initial judgment enforcing this stands.

While the CBN was permitted to release local government funds from the Federation Account, the court barred the use of such funds by those not duly elected.

All three appeals were dismissed, confirming that the prior judicial decisions on the election remain binding and enforceable.
