A Federal High Court in Abuja is set to deliver judgment on Monday in a case brought by the Department of State Services, DSS, against Professor Pat Utomi over his alleged plan to establish a shadow government in Nigeria. Justice James Omotosho fixed the date after hearing arguments from counsel and submissions from seven amici curiae.

The DSS maintains that such an arrangement is unconstitutional, warning it could destabilise the country, heighten political unrest, and embolden separatist groups. It is seeking a perpetual injunction restraining Utomi and his associates from pursuing the idea.
The security agency argues that Nigeria’s Constitution provides no basis for any authority outside an elected government, insisting that the proposal amounts to creating a parallel structure. Judgment in the case will determine the legality of Professor Utomi’s initiative.
