Court restrains NBC from sanctioning broadcasters over opinion

A Federal High Court in Lagos has restrained the National Broadcasting Commission from sanctioning broadcasters accused of presenting personal opinions as facts. The order was issued on Monday by Justice Daniel Osiagor.

The court granted an interim injunction preventing the commission, its officers and agents from enforcing or imposing fines based on specific provisions of the sixth edition of the Nigeria Broadcasting Code, pending the determination of a substantive motion.

The case follows a directive by the NBC warning stations and presenters against breaching professional standards, including expressing opinions as facts and failing to maintain neutrality in programmes.

The suit was filed by the Socio-Economic Rights and Accountability Project and the Nigerian Guild of Editors, who argue that the provisions are unconstitutional. The matter has been adjourned to June 1, 2026, for further hearing.
