A federal high court in Abuja has fixed September 29 to rule on an application by the Osun State government challenging its jurisdiction in the case over withheld local government funds. The state wants the matter transferred to the Osogbo division following the end of the Abuja court’s vacation.
Osun’s counsel, Musibau Adetumbi, questioned the legality of a letter assigning the case to Justice Emeka Nwite, claiming it was signed by someone “unknown to law.” He also argued that the fiat granted to the attorney-general of the federation to handle the case during the vacation had expired.

However, lawyers representing the Central Bank of Nigeria and the accountant-general opposed the objection, accusing the state of attempting to delay proceedings. They warned that the case could become irrelevant after the tenure of the affected APC chairmen and councillors expires on October 22.
The suit, filed by Osun’s attorney-general, seeks to stop the CBN and accountant-general from releasing local government allocations to APC chairmen elected in 2022. The state argues that their tenure was nullified by a court judgment upheld on appeal.
