Supreme Court to Hear David Mark Appeal Over ADC Leadership Dispute Tuesday

The Supreme Court has fixed April 14 for the hearing of an appeal filed by David Mark, National Chairman of the African Democratic Congress (ADC), in a leadership dispute within the party. The appeal challenges a suit filed by Nafiu Bala, a former Deputy National Chairman, who is contesting David Mark’s position as head of the party.

The appeal seeks to stay the execution of a Court of Appeal ruling delivered on March 12. The court had dismissed David Mark’s earlier case and directed all parties to return to the Federal High Court. Justice Emeka Nwite of the Federal High Court in Abuja has also fixed April 14 for the hearing of Nafiu Bala’s suit.

Other respondents in the matter include the African Democratic Congress, National Secretary Rauf Aregbesola, the Independent National Electoral Commission (INEC), and the party’s founder Ralph Nwosu. David Mark is asking the Supreme Court to restrain INEC from recognising any changes to the party’s leadership pending the determination of the appeal.

The dispute began in September 2025 when Nafiu Bala asked the Federal High Court to recognise him as Acting National Chairman, arguing that he did not resign his position and should succeed Ralph Nwosu. Following the Court of Appeal ruling, the commission announced it would not recognise either faction, prompting further legal action by the David-Mark led group.
