Nigeria’s Data Protection Commission says a Federal High Court has upheld its authority to compel Point of Sale agents to register as Data Controllers and Processors of Major Importance, dismissing a legal challenge seeking their exemption.
According to an NDPC statement, Justice F.N. Ogazi ruled in Emmanuel Harunna v. NDPC that the Commission acted within its statutory powers under the Nigeria Data Protection Act, and that registration doesn’t violate privacy rights but rather strengthens regulatory oversight of personal data processing.
NDPC has ordered all affected entities yet to register to do so immediately, warning of legal liabilities for non-compliance. Registration fees range from ₦10,000 to ₦250,000 depending on data-processing classification.
